Welcome to SoftlyWished, the first website dedicated to personalized video wishes and heartfelt digital messages.
By accessing or using our services, you agree to these Terms & Conditions. Please read them carefully before using the platform.

1 – Eligibility

You must be 18 years of age or older to use SoftlyWished.
By creating an account or submitting a wish, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.

2 – Services Provided

SoftlyWished creates and delivers personalized video wishes for special occasions.

• Free Plan: You receive the video to share yourself.

• VIP & VIP Ultra Plans: Recipients receive one or two email notifications, depending on your plan.

• Premium Plan: Includes scheduling, extra reminders, and priority support.

We currently do not create videos for funerals, political messages, or physical postcard deliveries.
SoftlyWished reserves the right to modify service features at any time.

All videos are delivered digitally via a private or public YouTube link, depending on your chosen sharing option. SoftlyWished does not provide downloadable files, printed media, or physical deliveries.

YouTube links may be shared as public or unlisted, according to your preference at the time of submission.

3 – AI-Generated Content Disclaimer

All SoftlyWished videos are partially AI-generated and created for personal, emotional, and entertainment use only.
We do not use real human likenesses, voices, or identifiable locations. Any resemblance to actual persons, living or deceased, is coincidental.

By using our services, you acknowledge that the content is digitally generated and not intended to impersonate or misrepresent anyone.

4 – Anonymity

Senders may choose to send wishes anonymously.
SoftlyWished will respect anonymity to the fullest extent possible but cannot guarantee complete anonymity if disclosure is required by law, court order, or in cases of abuse, fraud, or harassment.

Internally, SoftlyWished retains sender details and submission metadata (e.g., IP address, date, time) for legal and audit purposes.
This information will only be disclosed to authorities when legally required.

Sender data will be retained for up to1 month after termination of membership or releasing the video or as required by law.

5 – Legal Restrictions & Sender Responsibility

Senders must ensure that their message does not violate any legal restriction, restraining order, or no-contact order or any other court-ordered communication restriction.

By submitting a wish, the sender represents and warrants that:

1. They are legally allowed to contact the recipient.

2. The message does not breach any court order or restriction.

3. The message is honest, respectful, and not intended to harm, harass, or intimidate.

SoftlyWished reserves the right to refuse or cancel any submission that may violate these standards.

6 – Content Guidelines

All submissions must follow respectful and lawful standards. Wishes must not contain:

• Hate speech, discrimination, or threats

• Explicit, illegal, or harassing content

• Defamatory or harmful language

• Political or religiously offensive statements

SoftlyWished may review, edit, delay, or reject any request that violates these guidelines.

7 – Delivery Times

Free Plan: Delivery within up to 24 hours. VIP/VIP Ultra/Premium: Delivery within up to 48 hours with optional scheduling for Premium users.

While we strive to meet all timelines, minor delays may occur due to technical or operational factors. Delivery times are estimates, not guarantees.

8 – Refund Policy

SoftlyWished offers a fair and transparent refund policy:

• Full refund within 24 hours of payment if your video has not been produced.

• A 70% refund is available if you have not requested the creation of more than one video (whether published or unpublished).
  If you have requested the creation of more than one video, a 30% refund of the total payment will apply.

• No refunds after finishing the membership.

• Refunds are processed within 5–10 business days once approved.

9 – Intellectual Property

All videos, templates, designs, and creative assets remain the intellectual property of SoftlyWished.
You may share your purchased video privately or publicly, but you may not copy, resell, or modify our content for commercial purposes.

All media used in videos (music, visuals, effects) and Voices (means voice recordings uploaded by you under paid plans) are either licensed, royalty-free, or created by SoftlyWished.

10 – Emotional Impact & Disclaimer

SoftlyWished’s purpose is to spread kindness and positivity.
However, we cannot control how recipients emotionally react to a message.
By using our service, you acknowledge that SoftlyWished is not responsible for any emotional discomfort, misunderstanding, or personal dispute that may result from a wish.

SoftlyWished does not guarantee that recipients will appreciate, open, or respond positively to messages.

11 – Limitation of Liability

To the fullest extent permitted by law, SoftlyWished shall not be liable for:

• Delays caused by incorrect recipient information or email settings

• Technical interruptions beyond our control

• Emotional or personal disputes arising from messages

• These limitations apply to the fullest extent permitted by applicable law, even if SoftlyWished has been advised of the possibility of such damages.

Our total liability under all circumstances is limited to the amount you paid for the service.
SoftlyWished is not liable for indirect, incidental, or consequential damages, including emotional distress.

12 – Indemnification

By submitting a wish, the sender agrees to indemnify and hold harmless SoftlyWished, its owners, employees, and affiliates from any claims, damages, or legal actions arising from the message content or its delivery.

This includes claims of harassment, defamation, or violation of a restraining order.

13 – Opt-Out & Recipient Rights

If a recipient receives a message via SoftlyWished and prefers not to receive future wishes, they may contact support@softlywished.com.
We will honor all opt-out requests promptly.
Recipients may also report inappropriate or unwanted messages for review.

14 – Account Suspension or Termination

SoftlyWished may suspend or terminate any account or request that violates these terms, misuses the platform, or submits harmful or illegal content.
Decisions are final and made at our discretion.

15 – Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the courts located in Toronto, Ontario, Canada.

16 – Changes to Terms

SoftlyWished reserves the right to modify or update these Terms & Conditions at any time.
The revised version will take effect immediately upon posting.
Continued use of the platform constitutes acceptance of the updated terms.

We will notify you of significant changes by posting a notice on the website.

17 - User Responsibility

By submitting a wish, message, or image, you confirm that you own or have permission to share all materials you provide.
This includes text, photos, and other media uploaded to the SoftlyWished website.
You agree not to upload any content that violates privacy, copyright, or personality rights of others.

You are solely responsible for obtaining any necessary consent from recipients or individuals appearing in photos, videos, or messages you upload.

​18 - Use of Materials / Licensing (Photos, Videos, Voices & Other Media)

Uploaded photos and videos remain your property.
SoftlyWished only receives temporary permission to use them for the purpose of creating your requested video.
We do not retain or repurpose uploaded content beyond completing your order, unless you provide explicit written consent.

​Uploaded files are stored securely and automatically deleted once your personalized video has been completed and delivered, unless you request otherwise. SoftlyWished will never reuse or redistribute your files without written consent.​​

19 - photos, text, voices, audio, or any other media

This section applies to all users who choose to upload photos, videos, or other media as part of their submission.
When uploading a photo or video through the “Submit a Wish” form, you confirm that you have permission to share the image and understand it will be used solely to create your personalized SoftlyWished video. Uploaded materials are processed on secure servers and are not used for marketing or publication without your explicit consent.​​

20 - Voice Upload Terms

• Users must upload only their own voice or have permission from the person recorded.

• Users grant SoftlyWished a non-exclusive, limited license to use the voice recording only for the purpose of producing the ordered video.

• SoftlyWished will not reuse, sell, or share any voice recording.

• SoftlyWished may refuse audio that contains:

  • copyrighted music

  • another person’s voice without consent

  • inappropriate or harmful content

  • low-quality or unusable recordings (background noise, distortion)
