1 – Information We Collect

We collect limited personal information necessary to provide our services effectively and securely:

Account Information:

Name, email address, language preference, and selected plan type.

Wish Details:

Recipient name(s), occasion type, and optional personal notes or text provided for your message.

Payment Information:

Processed securely through trusted third-party payment processors (SoftlyWished does not store or access your full credit card details).

Technical Data:

IP address, browser type, and timestamp for security, compliance, and troubleshooting.
If you upload photos or videos (including recipient photos) through our forms, we collect and store these files securely for the purpose of creating and delivering your personalized SoftlyWished video. Uploaded content may include images of individuals, places, or personal moments that you choose to share.
You may optionally upload photos that do not include identifiable individuals (such as landscapes, pets, or symbolic images). These files are treated with the same level of security as personal photos.
We do not knowingly collect sensitive information such as government ID numbers, financial account access data, or health information.
Voice Recordings (Paid Plans Only):
If you choose to upload a voice message as part of a paid plan, we collect and store your audio file solely for the purpose of creating your personalized SoftlyWished video.
Your voice recording is stored securely.
It is never used for AI training, analytics, marketing, or any purpose unrelated to your video.
It is never shared, sold, or disclosed to third parties except our internal human editors who work on your video.
Voice files are automatically deleted within 30 days after the final video is delivered, unless required for troubleshooting or customer support.
By uploading a voice file, you confirm that the recording is your own or that you have obtained permission from any person whose voice appears in the file.

2 – How We Use Information

SoftlyWished uses your information to:

Create and deliver your personalized video wishes.
Send notifications or reminders to recipients (for VIP Ultra and Premium plans).
Confirm orders, provide updates, and respond to support inquiries.
Prevent fraud, abuse, or misuse of our services.
Improve website performance, personalization, and user experience.
Uploaded photos and videos are used only to produce the personalized video you requested.
We do not share, sell, or publish any uploaded content publicly without your explicit consent.
If you choose to make your video public or share it via YouTube, that content will follow YouTube’s own privacy settings (public, unlisted, or private) as selected by you.
Processing your data may include automated steps (such as AI-assisted editing) combined with human review to ensure quality and personalization.
We do not use your personal information for automated decision-making or profiling beyond what is required to personalize your video.

We may also use aggregated, non-identifiable data to understand trends and enhance service quality.

3 – Data Sharing

SoftlyWished does not sell or rent your personal information to third parties.

We share data only as necessary with:

Payment processors (for secure transactions),
Email delivery systems (for sending wishes or notifications), and
Video hosting platforms (for storing or sharing completed wishes).
Uploaded files are stored on secure Wix servers and are automatically removed from our workspace once your video is completed and delivered.
If you wish to have your files deleted sooner, you may contact us at info@softlywished.com to request removal.

We may disclose information when required by law, subpoena, or court order — or when necessary to prevent fraud, harassment, or harm.

4 – Anonymity & Legal Responsibilities

If you select “Send anonymously,” your name will not appear in the wish or in the recipient’s notification.
However, for compliance and safety reasons:

SoftlyWished securely retains sender identity, email, and submission data internally.
This information may be disclosed only if required by law, court order, or investigation of abuse.
Anonymous wishes cannot be used to violate a restraining order, no-contact order, or any other legal restriction on communication.

By submitting a wish, you confirm that sending this message does not violate any legal order or restriction.

If SoftlyWished becomes aware of such a restriction, we reserve the right to refuse delivery and may delete the message without refund.

5 – Recipient Privacy & Opt-Out Rights

Recipients who receive a SoftlyWished message will only see the content intended for them.
We do not share recipient information publicly.

Each email or notification clearly identifies SoftlyWished as the sender (not the user).
Recipients who prefer not to receive future wishes through SoftlyWished can contact support@softlywished.com, and we will honor all opt-out requests promptly.

6 – Data Retention

We retain your information only for as long as necessary to:

Deliver your wishes and manage your account,
Resolve billing or service inquiries,
Comply with legal, tax, and regulatory obligations.
After deletion, no copies of your photos or videos are retained on our servers or backups.

Senders may request deletion of their personal data at any time by emailing support@softlywished.com.
Certain transaction or compliance data may be retained as required by law.

All uploaded wishes, media, and voice recordings are deleted within 30 days unless required for customer support.

Your uploaded voice recordings, photos, and messages may be processed on secure cloud servers and on the work devices of our editors. These files may be handled in different countries based on where our team is located. All media is used only to create your video.

SoftlyWished uses Trustpilot, a third-party review platform, to collect and display customer feedback. Trustpilot may place cookies to verify reviews and improve user experience.

7 – Security

SoftlyWished uses encrypted connections (SSL/TLS) and trusted third-party platforms to process and store information securely.
We also maintain restricted internal access to sensitive information.

No online system is 100% secure, but we take all reasonable administrative, technical, and physical measures to protect your data against unauthorized access, loss, or misuse.

SoftlyWished uses Wix-provided infrastructure and third-party tools that maintain ISO-certified security practices.

SoftlyWished staff and contractors are bound by confidentiality agreements to protect all user content.

8 – Children’s Privacy

SoftlyWished is designed for users aged 18 and older.
We do not knowingly collect or store information from minors.
If we learn that we have inadvertently received data from someone under 18, we will promptly delete it.

9 – AI-Generated Content Notice

SoftlyWished videos are created with a blend of AI technology and human review for creative and entertainment purposes.
We do not use or recreate real human likenesses, voices, or identifiable locations.
Any resemblance to real people or places is purely coincidental.

SoftlyWished complies with emerging AI content-disclosure standards and includes visual or metadata indicators when videos contain AI-assisted elements.

By using our services, you acknowledge that your video is a digital artistic creation and not intended to impersonate anyone.

10 – International Data Processing

SoftlyWished operates in Canada but may use service providers (e.g., email or payment processors) located in other countries.
Your information may be processed or stored in these jurisdictions, where privacy laws may differ.
We ensure that such providers meet adequate data protection and security standards.

All activities are governed by the laws of Canada, and disputes will be handled in accordance with the Terms & Conditions.

11 – Your Rights

Depending on your location (e.g., Canada, EU, UK), you may have the right to:

Access, correct, or delete your personal information,
Withdraw consent for non-essential data use,
Request a copy of your stored data.
